1. Acceptance of Terms
By accessing, registering for, and using Ascend (hereinafter "the Service"), a web-based application offered by myaffirm.co (hereinafter "Company," "we," "us," or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, you may not use the Service. Your use of the Service constitutes your acceptance of this agreement. We reserve the right to modify these terms at any time, and your continued use of the Service following any such modifications constitutes your acceptance of the revised terms.
2. Description of Service
Ascend is a digital platform designed to provide personalized affirmation content, motivational guidance, and wellness-oriented information. The Service operates on a subscription basis and delivers daily affirmations, wellness prompts, progress tracking features, and related content to support personal development and mindfulness practices.
The Service includes the following features:
- Daily personalized affirmation content
- Wellness tracking and progress monitoring
- Interactive goal-setting tools
- Archive of past affirmations and content
- Customizable notification settings
- Account dashboard and user profile management
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, and without liability to you except as expressly provided herein.
3. User Accounts
To access the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to maintain secure credentials or from unauthorized access to your account resulting from your negligence.
You represent and warrant that:
- You are at least 18 years of age or have the legal capacity to enter into a binding contract
- All information you provide is truthful, accurate, and not misleading
- You will not impersonate any person or entity or misrepresent your affiliation
- You will not use the Service for any illegal, unauthorized, or unethical purpose
We reserve the right to suspend or terminate any account that violates these terms or that we believe poses a risk to other users or the Service.
4. Payment Terms
4.1 Subscription Pricing
Ascend is available by subscription at a cost of $9.00 USD per month. Pricing is subject to change with 30 days' notice. Any changes to pricing will not apply to current billing cycles and will take effect on your next renewal date. Your subscription grants you access to all features and content available through the Service during the subscription period.
4.2 Billing and Payment
Payment is due on the date you initiate your subscription and will recur automatically on the same date each calendar month unless cancelled. You authorize us to charge the payment method you provide on file for the subscription fee and any applicable taxes. If your payment method is declined or expired, we will attempt to charge alternative payment methods on file. If all payment methods fail, your access to the Service may be suspended or terminated.
4.3 Cancellation Policy
You may cancel your subscription at any time by accessing your account settings and initiating a cancellation request, or by contacting our support team at support@myaffirm.co. Cancellation will take effect at the end of your current billing cycle. You will retain access to the Service until the end of your paid subscription period. No refunds will be issued for partial months, and if you cancel during a billing cycle, you will not receive a prorated refund for the unused portion of that month.
If you cancel your subscription, your account data will be retained for 30 days in case you wish to reactivate your subscription. After 30 days, account data will be permanently deleted unless otherwise required by law.
4.4 Refund Policy
Subscriptions to Ascend are generally non-refundable. However, we recognize that situations may arise where a refund is warranted. The following refund policy applies:
- 7-Day Money-Back Guarantee: If you are not satisfied with Ascend within seven days of your initial purchase, you may request a full refund of your first month's subscription fee by contacting support@myaffirm.co. This guarantee applies only to first-time subscribers and only for the initial subscription period.
- Billing Errors: If you are charged in error or experience duplicate charges, contact us immediately at support@myaffirm.co with documentation of the error. We will investigate and issue a refund or credit within 10 business days if the error is confirmed.
- Service Unavailability: If the Service is unavailable for more than 14 consecutive days due to technical issues within our control, and you have made a good faith effort to report and resolve the issue with our support team, you may request a prorated refund for the period of unavailability.
- No Refunds for Cancellation: Except as expressly stated above, cancelling your subscription does not entitle you to a refund of any subscription fees already paid, even if cancellation occurs mid-billing cycle.
All refund requests must be submitted in writing to support@myaffirm.co within 30 days of the charge in question. Approved refunds will be credited to the original payment method within 10 business days.
4.5 Taxes
You are responsible for paying any sales tax, value-added tax, or other taxes applicable to your subscription. Tax rates will be calculated based on the billing address associated with your account. The subscription price displayed does not include taxes unless otherwise specified.
4.6 Price Adjustments
We reserve the right to adjust subscription pricing at any time. Changes to pricing will not affect your current billing cycle. Notice of price changes will be provided at least 30 days in advance, and your continued use of the Service after such notice constitutes your acceptance of the new pricing.
5. Intellectual Property Rights
All content, features, functionality, and materials contained in the Service, including but not limited to text, graphics, logos, images, affirmations, wellness prompts, software code, and design elements, are the exclusive property of myaffirm.co or its content providers and are protected by international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service and its content solely for your personal, non-commercial use, conditioned upon your compliance with these Terms of Service. This license does not permit you to:
- Reproduce, distribute, or transmit any content from the Service without our prior written consent
- Modify, adapt, translate, or create derivative works based on the Service or its content
- Reverse engineer, decompile, or disassemble any portion of the Service
- Remove or alter any proprietary notices, labels, or marks
- Use the Service or its content for commercial purposes or competitive advantage
- Scrape, crawl, or otherwise automatically download content from the Service
Any unauthorized use of intellectual property contained in the Service may violate copyright, trademark, and other laws and is strictly prohibited. We respect intellectual property rights and will respond to valid notices of copyright infringement in accordance with applicable law.
6. User Conduct and Prohibited Activities
You agree not to use the Service in any manner that violates applicable law or these terms. Prohibited activities include, but are not limited to:
- Transmitting any unlawful, threatening, abusive, defamatory, obscene, or offensive content
- Accessing or attempting to access the Service through unauthorized means or circumventing security measures
- Interfering with or disrupting the integrity or performance of the Service
- Attempting to gain unauthorized access to other users' accounts or data
- Uploading malware, viruses, or other harmful code
- Engaging in harassment, spam, or abusive behavior toward other users or Company staff
- Reselling, redistributing, or sublicensing the Service without authorization
- Using the Service for fraudulent purposes or in connection with illegal activities
Violations of this section may result in immediate suspension or termination of your account without refund, and may subject you to legal liability.
7. Limitation of Liability
